Terms of Service

1. Acceptance of Terms

By accessing or using NyvLearn (“the Service”), operated by Nyrven (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

NyvLearn is an AI-powered academic study companion that provides course-grounded answers, citations, and learning tools. The Service is provided for educational purposes only. It does not constitute legal advice, and you should not rely on it as a substitute for professional legal counsel.

3. No Warranty

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or free from hallucination. You use the Service at your own risk.

4. Limitation of Liability

To the fullest extent permitted by law, Nyrven and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

5. Indemnification

You agree to indemnify, defend, and hold harmless Nyrven and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

6. Intellectual Property

The Service and all content, features, and functionality — including but not limited to the NyvLearn name, logo, design, text, graphics, and software — are the exclusive property of Nyrven and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract the source code; (c) interfere with or disrupt the Service or its infrastructure; (d) use the Service to generate or distribute spam, malicious content, or content that violates the rights of others; (e) bypass any rate limits, authentication, or access controls; or (f) resell, sublicense, or commercially exploit the Service without a written agreement.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and without prior notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

9. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.


Privacy Policy

1. Information We Collect

We collect the minimum information necessary to provide the Service: your academic email address, name, institution affiliation, and the questions you submit to the AI assistant. We also collect anonymous usage analytics (Vercel Analytics) to understand how the Service is used.

2. How We Use Information

Your information is used solely to: (a) authenticate you and provide the Service; (b) maintain your chat history so you can resume conversations; (c) improve the Service through aggregated, anonymized analytics. We do not sell, rent, or share your personal data with third parties for their own marketing purposes.

3. Data Storage and Security

Your data is stored on secure cloud infrastructure (MongoDB Atlas) with encryption at rest and in transit. We implement reasonable technical and organizational measures to protect your data. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

4. Data Retention

Chat history is retained while your account is active. You may request deletion of your data at any time by contacting us. We will comply within 30 days, subject to any legal obligations that require retention.

5. AI and Third-Party Processing

Questions submitted to the Service are processed by third-party AI providers (including OpenAI) to generate responses. These providers do not use your data for training their models. All processing is governed by data processing agreements that comply with applicable data protection laws.

6. Cookies

We use essential cookies for authentication (session tokens). We do not use tracking cookies, advertising cookies, or third-party analytics cookies beyond Vercel’s privacy-focused Web Analytics. You can disable cookies in your browser, but the Service may not function correctly.

7. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal data, and to object to or restrict processing. To exercise these rights, contact us at the email below. We will respond within the timeframe required by applicable law.

8. Children’s Privacy

The Service is intended for university students and is not directed at children under 13. We do not knowingly collect personal data from children under 13. If you believe we have inadvertently collected such data, contact us immediately.

Security

NyvLearn takes security seriously. We employ industry-standard practices including:

  • All data encrypted in transit (TLS 1.3) and at rest (AES-256)
  • Session-based authentication with HttpOnly, SameSite cookies
  • Institutional email domain verification for account creation
  • Rate limiting on all public endpoints
  • Regular security audits of our infrastructure and dependencies

If you discover a security vulnerability, please report it responsibly to security@nyvlearn.com. We will acknowledge your report within 48 hours and work with you to resolve the issue. We do not pursue legal action against researchers who act in good faith.
